Privacy Policy

The privacy of our customers is of particular importance to us, MushMoons GmbH (hereinafter mushmoons). We therefore respect it, especially with regard to your use of our website at www.mushmoons.de. The protection of user and customer data is our highest priority, and we handle all information that users provide to us with exceptional care and responsibility. This naturally also includes cooperation with partners and third parties. Please note that internet-based data transmission can involve potential security vulnerabilities, and therefore complete protection against access by third parties cannot be fully guaranteed.
In the following, we would like to give you an insight into the type of personal data we collect, the reasons for doing so, and how we further use the data in connection with orders and communication with you. 1. Collection, processing, and use of personal data

Personal data is defined in Art. 4 No. 1 GDPR as all information relating to an identified or identifiable natural person. Examples include details such as name, date of birth, email address, or telephone number; under certain circumstances, usage data may also be included. Usage data refers to data required to use our website, such as information about the extent of the use of our website or login data.

The storage and processing of this personal data takes place without your explicit consent, in accordance with the applicable statutory provisions, only to the extent necessary to fulfill the contractual obligations between www.mushmoons.de and you or to ensure the provision of ordered products.

Furthermore, we collect, process, and use your personal data only if you expressly consent to this. Consent may be given explicitly when visiting our website or by sending your data to us. You can revoke your consent at any time without any disadvantages.

2. Automatic transmission of server data

Data that we or our web space provider receive from your internet browser is recorded for technical reasons. These so-called server log files include, for example:

·       The exact time of your request

·       The IP address you use

These anonymous data are stored separately from your personal data. This prevents any connection being made between the data and a specific person. The server log files are used solely for statistical evaluation in order to continuously improve our online presence and our offering.

3. Use of cookies

To increase the attractiveness of our website and to ensure the use of certain functions, we use so-called cookies on various pages. A cookie is a small text file that is temporarily stored on the respective end device. A distinction is made between session cookies, which are deleted after the browser session ends, and third-party cookies, which remain on the device and enable partner companies or us to recognize the browser you used upon your next visit. If personal data are processed by cookies, this is based, in accordance with Art. 6 para. 1 lit. b GDPR, either on performance of a contract or, in accordance with Art. 6 para. 1 lit. f GDPR, on preserving our legitimate interests in the optimal functionality of the website and in a customer-friendly and effective configuration of its use. Where applicable, we cooperate with various web partners who help us make our online offering even more attractive for you. For this reason, cookies from said partner companies may be stored on your device when you use our website.

4. Login function / Registration

To benefit from all our advantages, you can register with us. We require your name, your email address, and a password of your choice. This information is necessary to create a user account and to use the full range of mushmoons. We may also require additional information in order to respond to potential suggestions, questions, or feedback. To complete an order with mushmoons, we also require your full address and your account/payment details if required by the payment method you choose.

5. Newsletter function

5.1 Subscription to our email newsletter

If you would like to stay up to date, you can subscribe to our email newsletter. You will then regularly receive information about a variety of offers from us. The only mandatory information we require from you is your email address. All other information can be provided voluntarily and serves solely to address you personally. The newsletters are sent using the so-called double opt-in procedure. We will only send you a newsletter if you expressly agree to receive newsletters. After registering, you will receive a confirmation email from us, in which you confirm by clicking on a special link that we may send you our newsletter in the future.

Once the confirmation link has been clicked, you permit us to use your personal data in accordance with Art. 6 para. 1 lit. a GDPR. As soon as you register for the newsletter, your IP address generated by your internet provider, as well as the date and time of your registration, are transmitted to us. This helps us to better track any potential misuse of your data. All data that you provide during registration are used solely for promotional communication within the scope of the newsletter. If you no longer wish to receive our newsletter, you can easily unsubscribe by clicking the corresponding link in the newsletter or by sending us an email at info@mushmoons.de. Immediately after you unsubscribe, your email address will automatically be deleted from our newsletter distribution list, unless you have expressly consented to the further use of your information or we retain the use of your data within the legal framework, about which you are informed in this statement.

5.2 Sending the email newsletter to existing customers

If you provide your email address to us when purchasing goods or services on our website, we may regularly send you offers for our products or services by email, for example those you have already purchased. No separate consent from you is required for sending these emails, as the data processing is carried out exclusively for the purpose of personalized direct advertising in accordance with Art. 6 para. 1 lit. f GDPR. If you objected to receiving newsletters at the time of purchase, you will of course not receive any emails from us. If you wish to object to the use of your email address for the aforementioned advertising purposes, you can do so with future effect in the same manner as described above. As a rule, only transmission costs according to base rates will be incurred by you. After we receive your objection, your email address will no longer be used for any advertising-related measures.

6. Own advertising by mushmoons

Pursuant to § 7 para. 3 UWG (German Unfair Competition Act), we are entitled to use your personal data. This means that we can send you information and offers tailored specifically to your purchasing behavior and inform you about events and news relating to mushmoons. Our own advertising is based on the products you have previously purchased, i.e., you will receive information about similar goods or services. Data will not be passed on to third parties for advertising purposes. As before, you can also object to the use of your personal data for our own advertising with future effect. 7. Contact function

If you want to contact us, you can do so via the contact form we provide or by email. Your data and message will be stored to ensure appropriate communication. We naturally exclude the transfer to third parties. Furthermore, there is no comparison with previously collected data that we have obtained elsewhere on our website.

8. Use of Google Analytics

We use the online advertising application “Google AdWords” and the associated conversion tracking procedure. Conversion tracking is an analytics service offered by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”).

As soon as you click on an advertisement published by Google, your computer stores a cookie for conversion tracking. Since these cookies do not contain personal data and are only valid for a limited time, they are not used for personal identification.

If the cookie is still valid, we and Google are notified that the Google ad has redirected you to our website when you access certain pages on our website.

All Google AdWords customers receive different cookies, which prevents cookies from other AdWords customers’ websites from being tracked.

Data generated by the conversion process forms the basis for conversion statistics for AdWords customers who use conversion tracking. The AdWords customer receives information such as the number of users who clicked on the ad and were redirected to the website. However, users are not personally identified. To avoid tracking on your device, you only need to object to its use. This can be done through the appropriate settings in your browser. Your data will therefore not be included in the conversion tracking statistics.

8. Use of Google Analytics

At mushmoons, we use the Google Analytics web analysis service from Google Inc. By using cookies, Google Analytics enables us to perform precise analyses of your browsing behavior on our website. All data about your user behavior generated by the cookie are generally transmitted to and stored on a Google server in the United States of America. If IP anonymization is activated, Google will truncate your IP address if it is located in a member state of the European Union or in another contracting state that is part of the Agreement on the European Economic Area.

Only in certain cases will the user’s full IP address be sent to Google’s servers and then truncated. Google uses the information collected to evaluate user behavior, prepare reports on website activity, or interpret other matters relating to website usage. The IP addresses collected by Google Analytics are combined with other data generated by Google. As mentioned above, you can prevent cookies from being stored by making the appropriate settings in your browser. However, please note that the functionality of our website may be limited if cookies are refused. 10. Social media online presence on Facebook and Instagram

To improve communication between us and our customers and interested parties, we are active on various social networks. We share content with you about different products and current special promotions. When you access our social media presence, the data generated in the process can be used for advertising and market research purposes. User profiles are created for this purpose and stored under a pseudonym. These profiles form the basis for targeted advertising on and off the respective platform that may match your interests. For this reason, cookies are generally stored on the device you use, which determine user behavior and interests. This is based on Art. 6 para. 1 lit. f GDPR, where there is a legitimate interest in improving the presentation of our products and services and in effective communication between customers and interested parties. Art. 6 para. 1 lit. a GDPR forms the basis for data processing if you are asked by the providers of the social media platforms to consent to the processing of your data. This could be done, for example, by being asked to tick a checkbox. The location of the headquarters of the respective social media platform is crucial. If it is located in the USA, an adequacy decision in connection with the European Commission applies. The basis for this decision is the EU-US Privacy Shield. ·       Pursuant to Art. 77 GDPR, the right to lodge a complaint with a supervisory authority. You may choose the supervisory authority freely; as a rule, a supervisory authority at your place of residence, workplace, or company headquarters is consulted.

Via our imprint or the contact options we provide, you can obtain information about the collection and processing of your personal data stored with us, their authorization, reservation, or deletion, as well as any forms of consent or objection to certain uses of your data.
